TPS : le spectre d'expulsion massive inquiète des centaines de milliers d'Haïtiens
L'avenir des bénéficiaires haïtiens du Statut de protection temporaire (TPS) demeure marqué par une forte incertitude. Alors que les procédures judiciaires se poursuivent aux États-Unis, des informations publiées par le Miami Herald indiquent que l'administration américaine aurait déjà informé les autorités haïtiennes de la mise en place prochaine de deux vols de rapatriement par semaine, transportant chacun environ 200 migrants.
Selon le quotidien américain, ces rotations pourraient débuter dès la semaine prochaine. À ce stade, les autorités haïtiennes n'ont pas confirmé officiellement ces informations ni précisé les dispositions envisagées pour accueillir les personnes concernées.
Cette perspective suscite de vives inquiétudes parmi les organisations de défense des droits des migrants. La coordonnatrice du Groupe d'appui aux rapatriés et réfugiés (GARR), Katia Bonté, estime qu'Haïti ne dispose pas actuellement des conditions nécessaires pour recevoir un nombre important de ressortissants expulsés, évoquant la persistance de l'insécurité, de la crise humanitaire et des difficultés socio-économiques.
La question intervient alors que le dossier du TPS reste pendant devant la justice américaine. Après la décision de la Cour suprême autorisant l'administration américaine à poursuivre la procédure visant à mettre fin au programme, plusieurs recours demeurent en cours devant les juridictions fédérales. La juge Ana C. Reyes doit notamment se prononcer sur les aspects constitutionnels de cette affaire.
Dans l'attente de nouvelles décisions judiciaires, le Département de la sécurité intérieure (DHS) a prolongé jusqu'au 24 juillet 2026 la validité du statut et des autorisations de travail des bénéficiaires haïtiens du TPS. Les avocats spécialisés en immigration invitent toutefois les personnes concernées à faire preuve de prudence, à suivre uniquement les informations officielles et à consulter un professionnel avant toute démarche. Ils rappellent également que cette prolongation temporaire ne s'applique pas automatiquement aux permis de conduire expirés.
Le débat s'est intensifié après l'arrivée, ce 16 juillet, d'un nouveau vol d'expulsion au Cap-Haïtien transportant plus d'une centaine de ressortissants haïtiens. Selon plusieurs sources, il s'agissait du septième vol de rapatriement organisé vers Haïti depuis le début de l'année.
Le Premier ministre Alix Didier Fils-Aimé est intervenu publiquement sur le dossier en déclarant que, si le TPS demeure par définition une mesure temporaire, ce n'est pas le moment de renvoyer des ressortissants haïtiens dans un pays confronté à une grave crise sécuritaire et humanitaire. Cette prise de position intervient alors que plusieurs observateurs estiment que le gouvernement haïtien aurait dû engager plus tôt des démarches diplomatiques auprès des autorités américaines.
Selon les estimations, plus de 300 000 Haïtiens pourraient être affectés par la fin du TPS. Au-delà des conséquences pour les familles concernées, plusieurs responsables haïtiens soulignent également les répercussions économiques qu'aurait une réduction des transferts de fonds de la diaspora vers Haïti.
Alors que les procédures judiciaires se poursuivent et que le Congrès américain pourrait encore être appelé à se prononcer sur l'avenir du programme, des organisations de défense des migrants continuent de réclamer un moratoire sur les expulsions, estimant que la situation actuelle en Haïti ne permet pas un retour sécurisé et digne des bénéficiaires du TPS.
